WHO WE ARE

Carmen Abboy – Director

Carmen is admitted as an Attorney of the High Court of South Africa with eight years post articles experience in labour law. She has extensive experience in chairing disciplinary hearings, incapacity hearings and grievance hearings, training on labour legislation, conciliation and arbitration processes, and chairing disciplinary hearings.

Carmen is a specialist in employment-related disputes with extensive experience and expertise in individual labour disputes including unfair dismissals, unfair labour practice disputes, and unfair discrimination disputes. She has provided advice to clients in the sugar industry, the metal industry, motor industry, shipping, and logistics industry, and the wood and paper sector.

Carmen also has experience in collective labour law disputes, including protected and unprotected strike action, strike misconduct, and organizational rights disputes. She has appeared in the Labour Court, the Commission for Conciliation Mediation and Arbitration, the Motor Industries Bargaining Council, the Metal and Engineering Industries Bargaining Council, and the National Bargaining Council for the Sugar Industry.

Carmen has expertise in providing advice to clients on issues pertaining to misconduct, unfair labour practice disputes, unfair dismissal disputes, incapacity, unfair discrimination, employment equity, large and small scale retrenchments, section 197 transfers, sexual harassment, protected and unprotected strike action, unilateral changes to terms and conditions of employment, organisational rights disputes, exemption applications, and demarcation applications.

She also has extensive experience in drafting contracts of employment, executive agreements, service level agreements, collective agreements, mutual separation agreements and policies including disciplinary codes and procedures, alcohol policies, internet, and social media policies, leave policies, incapacity procedures, telecommuting policies, grievance procedures, and ill-health policies.

Carmen has served on the KwaZulu-Natal SASLAW (South African Society of Labour Lawyers) Committee since May 2015 and has served as the Chapter President from May 2018 to May 2020. She is currently the Chapter’s Vice-President.
